1. Who publishes this site

This site and the WhatsApp automated assistant are operated by Yoshimitzu Calderón Mozqueda, who operates commercially under the brand YCM360. YCM360 is a brand, not a company.

2. What these terms cover

They cover your use of this site and of the WhatsApp automated assistant, that is, our relationship with you before any signed contract exists between us.

They do not cover two things. The client portal and any contracted services are governed by the contract we may sign. And the processing of your personal data is governed by the Privacy Notice, not by this document.

3. This site does not sell or charge

No purchases are made here, no payments are processed, and no accounts are created. The site informs and lets you schedule a call. Any service is contracted afterwards, separately and in writing.

4. The automated assistant

The assistant that replies to you on WhatsApp is automated, and its replies are generated by a language model.

That carries three consequences worth stating plainly:

  • It can be wrong. Its answers may be inaccurate or incomplete.
  • It is not professional advice. Nothing it replies constitutes legal, tax, accounting, financial, or any other kind of professional advice.
  • It is not an offer. Nothing it replies constitutes a binding offer, a price, or a commitment as to timing or scope. Commitments are made in writing and signed.

If you need an answer you can rely on as a commitment, ask a person for it in writing.

5. Call scheduling

Bookings are made on a third party's platform. When you use it, that provider's terms also apply. The availability shown may change, and a booking does not in itself constitute a services contract.

6. Acceptable use

By using the site or the assistant, you undertake not to use them for unlawful purposes, not to attempt to compromise their operation or security, and not to send content you are not entitled to share.

We expressly ask you not to send identity documents, passwords, or banking details through the assistant. If you do, you do so at your own decision.

7. Site content

The text, images, video, design, and code on this site belong to the Controller or are used with permission, and may not be reproduced for commercial purposes without written consent. You may quote or share them citing the source.

8. Availability

The site and the assistant are provided as they are. They are not guaranteed to be continuously available or free from interruption, and may be modified or suspended at any time.

9. Limitation of liability

To the extent permitted by law, the Controller shall not be liable for damages arising from the use of the site or the assistant by anyone who does not have a signed contract with him, nor for decisions made on the basis of the automated assistant's replies.

This limitation does not apply to obligations that the law imposes on a non-waivable basis, nor to what is agreed in a signed contract, which is governed by its own terms.

10. Changes

These terms may be updated. The version in force is always the one published on this page, and the date of the latest update is shown above.

11. Governing law and jurisdiction

These terms are governed by Mexican law. For any dispute, the parties submit to the competent courts of Tijuana, Baja California, waiving any other jurisdiction.
